On April 14, 2005 a Utah Federal Judge overturned the FDA ban on ephedra products in her district impying that the FDA had not conclusively proven its basis for denying consumer's access to ephedra, particularly for products in her district containing 10mg of less of ephedra daily.
The FDA has appealed the Utah Judge's decision and disagrees with her order.
In the meantime, it is recommended that no person should take ephedra products, prescription or non-prescription, without the written permission of their Doctor.
