DUI LAWS COULD BE TOUGH FOR BALDWIN
WOODLAND HILLS, Calif. — Daniel Baldwin, one of the famous “Baldwin Brothers,” could be facing serious charges if he is arrested on suspicion of DUI.
Baldwin, 45, was involved in an accident in Los Angeles Wednesday afternoon after speeding through the city streets at speeds of up to 80 miles per hour. Among other charges, he faces a DUI charge (driving under the influence of an intoxicating substance) if it can be proven he was intoxicated, or if he was driving with a Breath Alcohol Content (BAC) of .08 percent or greater.
Darren Kavinoky, founding partner of The Kavinoky Law Firm, says that DUI charges can be very serious. “I don’t know all of the specific facts of his case, but I’ve represented many cases similar to Mr. Baldwin’s,” Kavinoky said. “Unfortunately for him, he could actually be facing a lengthy sentence because of his suspended license and reckless driving charges.”
California law says that driving with a suspended license and driving recklessly can be prosecuted in addition to DUI charges. Also, if convicted of DUI, these two charges could be enhancements that will add onto the mandatory jail sentence.
“If a person is convicted of driving under the influence and has a speed enhancement, he faces a mandatory minimum of 60 days in jail, not withstanding the additional time he may serve for driving on a suspended driver license,” said Stephen Lonseth, attorney at The Kavinoky Law Firm. “In addition, his license could be revoked for up to three years and he could be made to pay substantial fines.”
At the time of release, Mr. Baldwin had not been charged with DUI.
