February 21, 2007 (Press Release) --
by Jeremy Scholes and Severine Saintier
The only in-depth book dedicated to the domestic law of commercial agency which places it in its European civil-law context
Commercial Agents and the Law brand new book is a practical approach to the modern law relating to commercial agency agreements, a complete guide to the workings of the relationship between commercial agents and their principal within its domestic and European context.
The common law rules governing the relationship between principal and agent were pretty well established and well understood by English lawyers when, in 1993, the Commercial Agents (Council Directive) Regulations were enacted.
The 1993 Regulations implement EC Directive 86/653 on self-employed commercial agents. The 1993 Regulations, like the EC Directives, are not, however, a complete code of rules governing the relationship, so they have to co-exist with the pre-existing common law rules. Both sets of principles therefore have to be applied.
The aim of this book, which is by two authors each with many years' experience in this field (one an academic, one an academic and senior practitioner), is to dovetail the two sets of rules and to provide a detailed and comprehensive treatment of the law on the relationship between commercial agent and principal.
Purchase Commercial Agents and the Law and benefit from all this:
The only in-depth book dedicated to the domestic law of commercial agency which places it in its European civil-law context
Up-to-date legal information for all those responsible for drafting and negotiating commercial agreements
An insight into the civil-law rationale for protecting commercial agents and how it affects the Agency Regulations made under the EC Directive 86/653 as applied and interpreted by the UK courts since 1994
A detailed look at the French and German approaches to compensation and indemnity
