An architect, Stephane Sparta whose 41st –floor apartment in Upper East Side Manhattan building was destroyed when Lidle’s airplane crashed into the building on Oct.11, 2006, sues late New York Yankees’ pitcher Cory Lidle’s estate. According to Sparta’s lawyer, David C. Cook, the Cirrus SR-20 aircraft did not hit Sparta but the crash gave him a shock.
Los Angeles, California, May 23, 2007 – Sparta’s lawsuit was filed in Manhattan’s Supreme Court last Thursday with Lidle’s wife and administrator of his estate, Melanie Lidle named as the defendant.
According to Sparta’s court papers, his home was destroyed and he suffered from tremendous terror because of the crash, explosion and the consequent fire and smoke. Furthermore, the plaintiff claimed that he suffered from “extensive mental anguish, emotional distress and fear of physical harm.”
The physical damage to his apartment caused Sparta and his girlfriend to evacuate his apartment and moved into another in the same building.
The plane crash accident happened while Lidle, 34 and his flight instructor, Tyler Stanger, 26 was aboard. The aircraft hit the luxury building on the 30th floor, which was11 floors beneath the plaintiff’s apartment. The two were killed in the crash.
Before the accident, Lidle and Stanger took a flight past the Statue of Liberty and then headed north above East River during midday. Apparently, they encountered some trouble, as they turn back to head south.
The National Transportation Safety Board already conducted investigations. However, it has not reached conclusions about the accident’s cause, yet. There were also no reports accounting who among the two was operating the controls during the plane crash.
Sparta’s lawsuit was already the third filed against Lidle’s estate for damages caused by the plane crash. Presently, Sparta’s lawyer declared that he is trying to resume working but is still suffering from considerable emotional injuries due to the shock the incident caused. He has posttraumatic stress disorder, as said in his court papers.
Sparta’s lawsuit has no specified monetary damages.
Meanwhile, Melanie Lidle’s lawyer, Robert N. Clarke Jr. has not yet given any comments regarding the case.
However, last March, Clarke issued a statement declaring that the Lidle and Stanger families’ attorneys filed for wrongful-death lawsuits. The lawsuit is against the aircraft’s maker Cirrus Design Corp. based in California. Aside from wrongful death, the lawsuit charged negligence, product liability and other grievances.
