Pronouncement of JUDGEMENT Miss B.Schneider VS Mr. Z. Sesar ( Ex-Manager ,Hotel Victoria)

(Free-Press-Release.com) September 10, 2007 -- Miss B. Schneider is a victim of a heavily burglary , which happend in an APPARTMENT in Düsseldorf ( 7.02.2006) , Hotel Victoria , now called Hotel Petersburg .The defendant ,Mr. Z. Sesar is the Ex- Manager of the Hotel Victoria , is represented by B/S/H Advocats in Düsseldorf, Berliner Allee .

B.Schneider , the victim and complainant send witness reports , evidencesand photographes to the court as well as information and results about the investigations of the prosecutor and police in Düsseldorf . She was not satisfied with the investigations of the prosecutor and from her point of view it was not sufficient at all .

At the beginning of the process the defendant informed his hotel union , who send a letter to the compainant mentioning the manager will inform his insurance and a court trial will be not necessary . Then the defendant´s attitude changed and he ignored the case ,ignored the facts and summarized during the process at court diverse lies . The complainant´s advocat , Mr. von Moers ( Cologne) collected his salary in advance and when B. Schneider informed him about a mistake in his writing , which should have been send to the court ( complains) , he cancelled the mandate , although he had agreed ( e-mail) to discuss the case . Since last autum B. Schneider is fighting for damages personally at court .As a victim of a burglary it is a very stressful and unbearable task.
She is legally fighting for damages , compare GERMAN LAW - BURGLARY - HOTEL - REPONSIBILITY - SECURITY :
BGB § 702 Abs. 2 Article 1;
BGB § 701 Abs.1 and 2 ;
BGB § 280 Abs. 1 ;
STGB § 243 Abs. 1 .
Although it is well- known that fighting legally for damages is a “ BAD THING” in Germany , this case seems to be so far willingful unfair to the burden of the victim and complainant B. Schneider . Therefore she had to inform the president of the inferior court during the process .

In general , it is extremly worse , that the victims always have to fight twice for their rights , first to get a chance of justice at court with or without the prosecutor´s support and separately a second time to get a fair chance of receiving damages , which are - in all cases - very low in Germany .
