Two Technologies, Inc.® Takes Legal Action Against Datalogic
Horsham, Pennsylvania USA, September 20, 2007 ─ Two Technologies, Inc.® a leading manufacturer of customizable, rugged hand held computer & terminal products, filed a complaint on August 10, 2007 against Datalogic S.p.A., Datalogic Automation, Inc., and Escort Memory Systems in the Eastern District of Pennsylvania, Federal Court situated in Philadelphia, asserting Trademark Infringement. The complaint contends that Datalogic's use of the trademark "Jet" for its line of industrial PDAs constitutes trademark infringement and unfair competition.
Two Technologies uses the trademark JETT® for its line of rugged hand held computers since 2003. The mark JETT is attached to an entire product line of rugged computers as well as multiple associated peripherals. The United States Patent and Trademark Office issued Two Technologies a registration for its JETT mark.
"In good faith, Two Technologies' legal counsel notified Datalogic of confusion occurring internationally in 2005 and requested that they discontinue marketing their line of computers under the name "Jet". Datalogic refused and has continued to market and advertise their line of "Jet" hand helds globally for the last two years," stated Eric Eckstein, Two Technologies' President and COO. "The significant confusion in the marketplace has created major problems for us. At this point we have no choice but to take action to protect our product name and the reputation of our company."
