Martin & Martin, LLP Formed By Attorneys Kimberly Martin And Tom Martin To Handle Overtime Cases
Daughter/father team form Atlanta area law firm Martin & Martin, LLP to handle overtime claims.

In July 2007, Atlana attorney Kimberly Martin left a large international law firm to form a firm with her father attorney Tom Martin. Previously, Kimberly represented employers in all types of employment matters including overtime collective actions. She continues to represent employers. However, forming her own law firm allows her to take on select employee cases including overtime cases.
"Overtime cases alleging violations of the Fair Labor Standards Act for failure to pay time and half for all hours worked over 40 in a work week have skyrocketed over the last few years" says attorney Kimberly Martin. The cases range from employers improperly classifying employees exempt when the employees should be classified as non-exempt and entitled to overtime to cases involving employers requiring employees to work "off the clock" meaning the employees clock out but are required to continue working.
On November 19, 2007, Martin & Martin filed its first overtime collective action in the United States District Court for Northern District of Georgia. The case alleges that a major national retailer failed to pay overtime to a specific class of sales people who always or almost always only receive their monthly draw and never or almost never receive additional compensation in the form of commissions. The complaint alleges that the class of sales people are entitled to overtime, "liquidated" or double damages, and attorneys' fees.
