Los Angeles -- On Wednesday, April 9, 2008, The Honorable Judge Joe Hilberman of the Los Angeles Superior Court granted a Preliminary Injunction in favor of authors Pol’ Atteu and Patrik Simpson, authors of Anna Nicole Smith Portrait of an Icon. The original Complaint For Damages filed in Los Angeles Superior Court, on February 25, 2008, Atteu, Simpson vs. Gibson, Case No. SC097218 is set for a Status Conference June 16, 2008. THIS CASE IS NOT OVER! DEFENDANT GIBSON MISREPRESENTED TO MEDIA THAT IT IS – NOT TRUE!! The Complaint sets forth the following Causes of Action: Breach of Contract; Fraud, Interference with Economic Relations, Damages, Intentional Interference with Contract, Breach of Fiduciary Duty, Accounting, Unjust Enrichment, Conversion and Unfair Competition.

Plaintiffs Atteu and Simpson were granted the Injunction against Gibson to stop her from interfering with their right to sell their book, among other things. AGAIN, GIBSON MISREPRESENTED TO THE MEDIA THAT ATTEU & SIMPSON LOST – NOT TRUE!! This is a major victory for Atteu and Simpson because a Court very rarely grants an injunction unless it is proven that irreparable damage will be caused if the offending party (Gibson) is not immediately stopped and enjoined by the Court. This is exactly what the Honorable Judge Joe Hilberman decided.

California law requires that every prevailing party for an Injunction must post a bond according to Code of Civil Procedure Section 529. THIS IS STANDARD PROCEDURE, NOT SOMETHING SPECIAL THAT THE JUDGE ORDERED AS DEFENDANT GIBSON ALLEGED! Plaintiffs’ Atteu and Simpson posted a $10,000 bond as required by California law.

Judge Hilberman acknowledged that Defendant Gibson’s actions of contacting Amazon.com to have Plaintiffs’ version of their book removed from the website constituted improper interference with Plaintiffs’ own third party contracts and Defendants must be stopped from continuing to interfere with Plaintiffs’ attempt to market their own work. Further, the Honorable Judge Hilberman noted that a letter sent by Plaintiffs’ attorney on January 25, 2008, appeared to operate to terminate the agreement between the parties and Defendant Gibson’s failure to comply appears to have been improper.
