File Sharing-The Consequences
File Sharing has become one of the most common ways of transfering files via the internet. However there are ongoing debates of its true legality.
for those who do not understand file sharing, I will give you a very brief description. File sharing (aka p2p) is a system that allows its users to share the files that they have access to on their computers. These files are transfered to the sponsoring program i.e. bearshare, limewire, itunes, and that program relays them to you. Thats it, that is file sharing!
Now back to the point. Is it legal and what are the consequences?
File sharing is 100% legal IF and only IF you have the rights to redistribute that material to the general public. for example: it is perfectly legal to share files or say movies that you have created yourself however if you have a movie that you rented from the store and copied onto your computer for purposes of redistribution that is when it becomes illegal. The copywrite laws that are imprinted or burned into dvd's, cd's and other files are there for a reason. They are put in place to protect the person or persons that created the product and to insure that they receive the funding that comes from sales of the product. If we share them online without rights to share, then these people are not getting the money that is owed to them for their product.
The consequences of illegal file sharing are very great. Judgement is usually done on a case by case bases therefore it is hard to determine exactly what sentence you would receive if caught however I can give you several examples of the high fines that have been given to those who have been convicted. Penalties for illegal file sharing and downloading copywrited materials can include but are not limited to jail time and up to 150,000.00 per song!
So what do I recommend? I would use a program such as sharefilz.com (this is purely and example) that would allow you to purchase a membership to the site and files they have. Sites like these have bought or purchased rights to redistribute these files to prevent its users from incurring fines and such for downloading files illegally.
