Attorney General Complaints Filed Against Dependable Auto Shippers (DAS)
Rick Ivie of Phoenix, AZ has submitted Attorney General Complaints in Arizona, Texas and Alabama against Dependable Auto Shippers (DAS) and Birmingham Towing.
FOR IMMEDIATE RELEASE
(Free-Press-Release.com) June 3, 2008 --
Rick Ivie contracted Dependable Auto Shippers (DAS) to transport a fully restored 1964 Ford Galaxie 500 from Birmingham, AL to Phoenix, AZ. He paid the $660.00 fee upfront and had the car dropped off and Birmingham Towing as instructed by DAS.
DAS contracts with different towing companies and storage lots throughout the nation as drop-off and pick-up points for customers vehicles. Unfortunately many of the drop off points are in extremely bad neighborhoods and DAS has little to no control of what happens to these cars once the towing companies have them in their possession.
As was the case with Mr. Ivie’s fully restored 1964 Ford Galaxie. The person dropping the car off for Mr. Ivie witnessed the owner of Birmingham Towings son pull the hood pins, open the hood and inspect the engine, drop the hood, get inside the car and start revving up the engine in a very unsafe manner. It is a custom show car with a healthy engine that might have enticed his son to abuse it in the manner he did.
The car arrived in Phoenix with 40 to 45 undocumented miles and a blown transmission.
Rick Ivies’ repeated attempts to have the car repaired by DAS have gone unanswered and has only been given responses such as “if there were extra miles then the receiver in Phoenix would have documented it and since he didn’t we assume there were no extra miles”. When DAS was confronted with a demand to see the bill of laden that shows the mileage once the car reached Phoenix, AZ he was denied. “I was told that I am not allowed to view that document”, Mr. Ivie said upon asking for proof.
Rick Ivie said he never new he had to buy insurance to protect himself against DAS, the people he paid to move the car. Mr. Ivie had insurance on the car that even covered damage during transportation but it does not cover abuses by humans. Mr.Ivie said “plain and simple, the abuses by the owners son along with the undocumented 45 miles makes them liable for the damage”. Dependable Auto Shippers (DAS) admitted that Birmingham Towing violated their contract and agreement by abusing the car but were still unwilling to settle the claim.
Rick Ivie plans on suing DAS and Birmingham Towing for the repairs, loss of vehicle, legal fees and damages. DAS has had approximately 336 Better Business Burea complaints in just the last 36 months; many go unresolved and they currently hold an “unsatisfactory rating”.
Look for a web-site that is being put together for a small class action suit involving DAS. The suit will involve false advertising, personal property damage and seeks claims for those involved.
