By law if there is anything on your credit report that is; outdated, obsolete, misleading, or/and unverifiable it should not be there. Keep in mind that the "burden of proof" falls on the credit agency not you.
1) Go to http://www.annualcreditreport.com
Print out each credit report (free)
2) Type the following letter; include a copy of your driver’s license and social security with each letter you send. Current address
Your name address, social security number will go on the top right side and also on bottom right side. Credit agency address will go on the top left.
RE: COMPLAINT LETTER TO REMOVE ITEMS FROM CREDIT FILE
DEAR SIR OR MADAM:
I received a copy of my credit report and I dispute the following items.
1. Account name account # balance (if any) not mine or never late
Leave balance blank if it’s Never late acct
Example:
1. abc company #111111 $100 Not mine
2. xyz company # 22222 Never late
and so forth.....
After listing each adverse account in neat columns. continue typing letter as follow;
I have no knowledge of any of these accounts. I request you contact the reporter of these accounts and determine their origin. I also request a copy of the original credit applications with my signatures on them. Please also send me the names and addresses of the individuals you contacted, so I may follow up.
Under the provisions of the fair credit reporting act 611(A), please re-investigate and delete accounts. I shall assume 30 days constitutes "reasonable time" to complete these actions. It should be understood that failure to re-verify within this time constitutes non-verifications and the items must be promptly deleted according to section 611(A).
In addition, there is a serious possibility that you have not followed the permissible purpose provisions of the federal fair credit reporting act regarding inquiries placed on my credit file. The act specifies that you must document your reasons for including such inquiries on my report and, when in error, remove them as well. I am depending on the credit bureau to follow the law: either provides documentation that the law was followed by contacting the inquirers at once, or remove the offending inquiry immediately.
ALSO, PURSUANT TO SECTION 611(D) OF THE FAIR CREDIT REPORTING ACT, PLEASE SEND ME NOTIFICATION THAT THESE ITEMS HAVE BEEN DELETED, SEND AN UPDATED COPY OF MY CREDIT REPORT TO THE ADDRESS MENTIONED BELOW, ACCORDING TO THE PROVISIONS OF 612, THERE SHOULD BE NO CHARGE FOR NOTIFICATION OF CHANGES ON MY CREDIT REPORT.
