Teleperformance Customer Service Representatives File Lawsuit for Unpaid Wages

Group Of Current and Former Customer Service Representatives of Teleperformance USA (TPUSA and Calltech Communications) Have Filed a Class Action Lawsuit for Alleged Unpaid Wages & Overtime

(Free-Press-Release.com) December 23, 2008 -- Recently a group of current and former customer service representatives (CSRs) filed a lawsuit for unpaid wages and overtime against their call center company—TPUSA, Inc. (Teleperformance USA including CallTech Communications, LLC). Teleperformance is a call center company with 246 call centers in 46 different countries, including calls centers in 11 different states in the U.S.

This lawsuit involves certain employees who are currently or were previously employed by Teleperformance at its “Contact Centers" or “Call Centers,” and also in the work-at-home program ("WAHA") as Customer Service Agents or Representatives who claim to have performed any off-the-clock work. Plaintiffs have filed the lawsuit as a collective/class action in the Federal District Court in Salt Lake City, Utah. The Court has not yet certified the lawsuit as a class action. Plaintiffs allege that these actions of Teleperformance violate provisions of the Fair Labor Standards Act (FLSA). Plaintiffs also allege damages under laws of the states of Florida, Georgia, Idaho, Illinois, Indiana, New Mexico, Ohio, Pennsylvania, South Carolina, Texas and Utah, where Teleperformance (and CallTech Communications) operates its call centers.

Among other things, the Plaintiffs in this lawsuit have alleged the following: That Teleperformance did not pay employees for pre- and post-shift activities, such as logging in and out of the company’s computer system both before and after beginning to take calls; that they had to wait for an available work station, and that Teleperformance did not pay them until they were actually logged into a work station and were ready to take calls; that Teleperformance deducted minutes from employees’ pay for short periods during the workday when employees were logged out of the Teleperformance computer system, such as when they took a break to use the restrooms, equipment malfunctions, and if the CSRs took longer than allowed time for "after call work time," etc.; that Teleperformance did not pay Work-at-home (WAHA) employees for time spent during scheduled shifts for travelling to meetings, and/or taking Teleperformance’s equipment back to the call centers for repair or troubleshooting; and that Teleperformance deducted time from employees’ pay for other periods during which employees were logged out of the system for any reason. The lawsuit has met with considerable support by the employees with over 200 current and former employees joining the lawsuit already. Any employee who works or worked for Teleperformance as a customer service agent in the last three years may be eligible to join the lawsuit.
