"Lawsuit Response Filed in Response to Call for Hearing"
Monday, April 20, 2009 – Monroe, GA: At a hearing held on March 6, 2009, in the Superior Court of Walton County, Angel Food Ministries and the plaintiffs, Craig Atnip and David (Tony) Prather, entered into an agreement to settle the case brought to bear on the Ministry. It was the understanding of Angel Food Ministries that this agreement was a full and final resolution of the lawsuit and it was clearly understood and agreed upon then by Atnip and Prather that this agreement would be the final resolution as well. The Ministry hopes to see the agreement enforced, either through consensus of the parties or through the legal process.
During this period, Angel Food Ministries has forged ahead in the fulfillment of its mission to feed America and has reached record months for its food distribution. Pastors Joe and Linda Wingo have relentlessly worked to minister to an ever-growing population seeking relief from economic stress. The lawsuit is nothing more than a distraction from the core undertaking of Angel Food Ministries, but not enough of such to keep the important work from getting done.
Based upon the agreement, Angel Food Ministries has attempted, in good faith, to come to a formal Settlement Agreement that reflects, in all material senses, the understanding of the parties. In fact, Angel Food Ministries has determined to fulfill its obligations in the March 6th resolution without a settlement being reached.
While various drafts have been submitted by Angel Food Ministries, Atnip and Prather have reneged on their agreement. They have drafted their own versions of the Settlement Agreement which, in each instance, do not reflect the terms agreed upon by the parties on March 6, 2009.
Angel Food Ministries (www.angelfoodministries.com) is a non-profit, non-denominational organization dedicated to providing financial support in the form of food relief to communities throughout the United States. Established in 1994 to provide relief for struggling families in the Monroe, GA area, Angel Food Ministries today serves hundreds of thousands of families across now 40 states, having added Arizona in March 2009. Since inception, Angel Food Ministries has fed more than 20 million Americans. In 2008, AFM provided $140 million in direct food assistance to American families.
Angel Food offers a medium-sized box of food for $30 that contains top quality food staples from every food group, including chicken or beef, milk, eggs, vegetables and other nutritious items. One box of food feeds a family of four for about one week, or a single senior citizen for almost a month. The menu varies each month, and consists of both fresh and frozen items with an average retail value of approximately $60.
