Renegotiating Barnett Shale Leases Can Open Doors for $Millions: Texas Oil & Gas Lawyer Humphreys
Oil and gas properties that are no longer paying royalties can be turned into potential gold mines with the right legal action now, according to Weatherford, Texas oil and gas attorney Mark Humphreys.

WEATHERFORD, May 19, 2009 – Old oil and gas leases can be turned into a potential gold mine for royalty owners if they take the right steps now to obtain more favorable terms, according to Weatherford oil and gas attorney Mark Humphreys.

Potentially Millions of Dollars
“We’re not talking about a signing bonus of a couple hundred bucks,” Humphreys noted. “We’re talking about potentially millions of dollars in royalties on a bigger lease, and certainly thousands of dollars even on the smaller leases in the Dallas-Fort Worth area.”
Humphreys described it as “a real big mistake” for a landowner to focus only on the two paragraphs out of the 20 or more in a typical lease that address the bonus and royalty amounts. Typically found in oil and gas leases are provisions governing:
• Habendum clause estate ownership rights
• Force majeure declarations
• Pooling agreements
• Lease termination requirements
• Post-production land use
• New wells and wells on adjoining properties wells
“Every paragraph in a lease means something,” according to Humphreys. “The oil and gas companies pay big bucks to landmen and lawyers to review and negotiate the leases. Yet all too often a landowner talks to his next door neighbor and decides whether it’s a good deal or not. You’ve got to have a lawyer look at these things,” Humphreys added.
